Two coverages, almost the same name, completely different jobs. Confusing them is the most common insurance mistake made by auto repair shops, body shops, detailers, tyre stores and dealers, and it is usually discovered in the worst possible way: a customer's vehicle is damaged, the shop calls the carrier, and the carrier explains that the policy in force answers a different kind of claim.

Here is the distinction, in plain terms.

Garage liability

Garage liability is the general liability policy written for automotive businesses. It answers bodily injury and property damage arising out of your premises and your operations, and it includes the auto exposure that comes with running a shop.

What it looks like in practice:

  • A customer slips on a wet floor in the waiting area and breaks a wrist.
  • A technician test-driving a car causes a collision on Johnston Street.
  • A brake job is done badly and the vehicle is involved in a crash afterwards — that is products and completed operations, which garage liability includes.
  • A shop vehicle backs into a parked car in the lot.

What it does not do is pay for damage to the customer's car while that car is sitting in your bay. It excludes property in your care, custody and control, which is exactly what a customer's vehicle is.

Garage keepers

Garage keepers is the coverage for customers' vehicles in your care, custody and control. It is the policy that answers when:

  • A fire in the shop damages six cars waiting on parts.
  • Someone breaks in overnight and takes wheels off two vehicles on the lot.
  • Hail comes through and dents everything parked outside.
  • A technician backs a customer's truck into a lift post.
  • A vehicle is stolen off the lot with the keys in the box.

If you take possession of vehicles you do not own — and every repair shop, body shop, detailer, tyre store, dealership, valet operation and towing business does — you need this. Garage liability alone will not answer any of the claims above.

The three garage keepers forms

This is where the detail lives, and where two shops with identical-sounding policies can be in very different positions.

Legal liability

Pays only when the damage was your fault. If a fire started by the building next door burns customer cars in your lot and you were not negligent, a legal liability form may not respond. It is the cheapest of the three and the one most often sold on price.

Direct primary

Pays for damage to the customer's vehicle regardless of fault, and pays before the customer's own auto policy. It is the strongest position and the best customer experience: the vehicle gets fixed without an argument about who was at fault or a claim landing on the customer's personal policy.

Direct excess

Pays regardless of fault, but sits after the customer's own coverage. Their policy pays first, yours pays what is left. Cheaper than direct primary, and it means your customer takes a claim on their own record for something that happened at your shop.

If your declarations page says garage keepers, read on to see which of the three it is. That word matters more than the limit next to it.

The limit, and how it is applied

Garage keepers limits are normally written per location, and the number needs to reflect the peak value of vehicles on your premises, not the average. Ask yourself what is on the lot the night before a holiday weekend, or during storm season when everyone is bringing vehicles in at once. A shop with a $100,000 limit and $260,000 of customer vehicles parked outside is underinsured on the one night it matters.

Check the deductible too. Garage keepers deductibles are frequently written per vehicle, which is fine for one backed-into truck and painful for a hailstorm that damages fifteen cars at once. Some carriers offer a per-occurrence maximum. It is worth asking for.

What neither coverage does

Even with both in place there are predictable gaps.

  • Your own building, equipment and parts inventory. That is commercial property, a separate coverage. Lifts, alignment racks, diagnostic equipment and the parts room are usually worth more than owners estimate.
  • Your employees' injuries. That is workers compensation, and it is required in Louisiana for businesses with employees. Auto repair is a class with real injury exposure.
  • Flood. Excluded from commercial property just as it is from homeowners. A shop on a low lot in Lafayette Parish should price it separately; see flood insurance.
  • Faulty workmanship on the part you worked on. Products and completed operations answers the damage the failure causes, not the cost of redoing your own bad work.
  • Employee dishonesty. Theft of customer property or shop assets by staff needs a crime form.
  • Cyber. Modern shops hold customer contact details, payment information and increasingly vehicle telematics data.
  • Business income. If a fire closes the shop for three months, garage keepers pays for the cars and property pays for the building. Neither replaces the income.

Louisiana specifics worth checking

Businesses that sell vehicles, as opposed to only servicing them, fall under the Louisiana Motor Vehicle Commission, which sets licensing requirements and often bonding and insurance conditions with them. If your shop has moved from repair into any amount of retail sales, that is worth confirming against the current rules at lmvc.la.gov.

On the insurance side, the Louisiana Department of Insurance publishes consumer and business guidance, licence lookup and the complaint route at ldi.la.gov.

The other Louisiana-specific item is weather. Hail and wind are not exotic risks here, and vehicles stored outside overnight are the single largest garage keepers exposure most shops have. If you have covered storage, say so when you are quoted; if you do not, make sure the limit assumes an open lot.

A short audit for a shop owner

  1. Do you have both garage liability and garage keepers, or only one?
  2. Which garage keepers form is it — legal liability, direct primary or direct excess?
  3. Does the limit cover the peak number of customer vehicles on site, not the average?
  4. Is the deductible per vehicle or per occurrence?
  5. Are your lifts, alignment rack, diagnostic equipment and parts inventory scheduled at real values?
  6. Is workers compensation in place for every employee?
  7. Have you priced flood separately?
  8. Is there business income coverage, and for how many months?

Most shops can answer the first question. Far fewer can answer the second, and the second is the one that decides how a claim goes.
